Jarbas App Terms of Use

Dear User,

In order for you to register and use the services offered by JARBAS SOFTWARE E SERVICOS LTDA, registered under CNPJ 53.732.154/0001-34, it is essential to read, understand and fully accept these Terms and Conditions of Use of the Site. If you do not agree with any term, do not use our services. Only people over 18 years old can register and use the platform. If you have any questions, please contact us by email help@jarbas.app.

CHAPTER I – HOW THE JARBAS PLATFORM WORKS

Jarbas' goal is to help manage a small business. These terms are directed to you, small entrepreneur. The platform consists of the mobile application "Jarbas App".

The application is available for Android or iOS phones and can be downloaded for free from Google Play Store or Apple App Store. In this application it is possible to register products, record sales, issue receipts, consult history and sales statistics among other functionalities.

Important: Any purchase and sale or service contracting takes place without direct involvement from Jarbas. If you, Customer, notice something wrong with your transaction, any compensation must be claimed from the Seller with whom you negotiated. Jarbas' responsibility is limited to providing the space and tools.

CHAPTER II – APPLICABILITY OF TERMS OF USE

These Terms of Use may be reviewed at any time, and any modifications made by Jarbas will take effect at the time of their implementation. Platform Users will be properly notified of the update by email. If there is no objection, we will understand that you have accepted the changes made. Therefore, it is important that you review these Terms periodically, preferably every time you access the platform and pay attention to emails sent by Jarbas.

CHAPTER III – USE RESTRICTIONS FOR USERS

If you want to sell a product, you may not, in any way, insert, transmit, disseminate or make available to third parties through our platform, any type of product, service, material or information whose commercialization is prohibited by current legislation and public order, these Terms and Jarbas policies.

In summary, products that do not ensure the safety of all users, with potential to cause damage or violate third-party rights, that have signs of illicit or stolen origin and/or that may be used to carry out illegal activity, among others, are not eligible for advertising and sale on the site. Attached to this document is a detailed list of products and services prohibited on Jarbas.

CHAPTER IV – YOUR JARBAS ACCOUNT

A. Creating the account

To browse the Jarbas website you will not need to register.

To use Jarbas App the Seller will need to provide name, email and define a login password. It is also possible to access with Facebook, Google and Apple accounts for Sellers using the iOS system. Extra information such as phone, address, store name, among others, may be requested in the application registration.

When registering, whether through Facebook or directly on the platform, you assume responsibility for the accuracy and veracity of the information provided, which may be verified by Jarbas at any time. You also assume responsibility for keeping this information updated.

With this, you will have access to the platform through login and password. To protect your account, your password must be kept secret and should not be shared. Activities performed on Jarbas using your account will always be your responsibility.

B. Verification of registration information

Jarbas may use all valid and possible means to identify its users, may request additional data and documents to verify the personal data informed, as well as disable, temporarily or permanently, registrations that present any false information or that cannot be confirmed.

In case of false or unconfirmed information, you will receive a notification to correct the information in a timely manner. If there is no correction, Jarbas reserves the right not to complete the ongoing registration or, still, to block the existing registration.

This Jarbas analysis does not entail commitment, guarantee, obligation or responsibility regarding the veracity of information and content inserted by users.

C. Account information

Data provided by users may be used to send promotions, notices, notifications and news by Jarbas. Always keep your email address updated!

D. Use of registration by third parties

Registrations on the platform are individual and non-transferable.

In this way, you:
i) may not share your login and password with third parties;
ii) must be careful with your identification data;
iii) must be diligent in using the content available on Jarbas; and
iv) must strictly follow all determinations of these Terms of Use.

You must immediately notify Jarbas of any unauthorized use of your user account or any other security breach.

Jarbas is not responsible for any losses or damages arising from the use of login and password by third parties, with or without the user's consent, if this is not made possible by site system failures.

E. Account suspension and exclusion

If you do not comply with any of the conditions of these Terms, Jarbas may close your accounts and suspend or cancel your access to the platform, without prior notice. Use your account responsibly and don't forget to always follow the updates of these Terms of Use.

CHAPTER V – PLATFORM USE

A. Registrations

You can register the products and services offered, including images and photographs. You must be responsible for the images used, including for any infringement of third-party rights.

Jarbas may, at any time, adapt and/or delete images, photographs and videos included in your records, if they are not in accordance with the rules of these Terms of Use, especially images and other visual resources that represent prohibited products and services, listed in Annex I or illegal activities.

B. Plans and remuneration

You can download and browse the platform for free for 7 days after registering your account. After this period, you can hire the "Individual plan" or the "Pro plan", whose functionalities are detailed in this link, through monthly payments. Payments will be charged through monthly or annual subscription, through partner payment companies.

Jarbas values acting according to its users' expectations. Thus, we avoid increasing the rates of our services for old users. But we cannot commit to always doing this. Thus, Jarbas can modify, increase or delete current rates, as well as the remuneration format, at any time. If this occurs, you will be notified 30 days in advance and, if you do not express disagreement within the deadline, the modifications will be understood as accepted.

C. Financial Control

You can register financial transactions to control your business. These transactions can be expenses or receipts. This registration is merely informative. Jarbas is not responsible for registered expenses or receipts that are not effectively paid by the creditor.

CHAPTER VI – PLATFORM AVAILABILITY

Jarbas does not guarantee the availability, access and continuity of the platform's operation or its functionalities, current or future, and is not responsible for any damage or loss caused to you in case of unavailability.

CHAPTER VII – LIMITATION OF LIABILITY

Jarbas will respond exclusively and limitedly for providing virtual space for hosting users' product management system through the platform.

Jarbas reiterates, considering the platform's services, that it is not the owner of the advertised products, does not keep possession of these items and does not make sales offers, nor does it intervene in product delivery. Therefore, it is not responsible, consequently, for the states of products offered or acquired, or for the veracity of personal data inserted by them in their registrations.

Jarbas will not be responsible for any losses or damages suffered, resulting from: (i) any wrong or incomplete information provided by a user; (ii) any fraud, fraudulent statement or breach of duty, or violation of any of the conditions by a user; (iii) connection failures; (iv) data processing problems due to third-party fault; (v) poor service provision by the user or misleading advertising contained in their advertisement; and (vi) any advertisement that contains offensive, improper material or that violates current legislation.

If Jarbas is harmed by demands promoted against it, due to conduct by users or third parties on its platform contrary to the law or these Terms of Use, it will exercise the right of recourse, claiming the due compensation.

CHAPTER VIII – INTELLECTUAL PROPERTY

The commercial use of the expression Jarbas as a brand, corporate name or domain name, the logo, as well as the screen contents related to the platform, as well as its programs, website, databases, networks, files that allow the user to access and use their account, are exclusive properties of Jarbas and are protected by laws relating to intellectual property.

It is not permitted to reproduce, duplicate, copy, sell, resell, visit, or in any other way exploit for commercial purposes the content of the Platform without the prior written consent of Jarbas.

CHAPTER IX – PLATFORM CHANGES

The Jarbas platform undergoes constant improvements. Thus, the service provided by us may be changed, suspended and/or discontinued without prior notice.

CHAPTER X – CONFLICTS

We always value the search for better solutions for users and seek to maintain a positive business environment on our platform. If you have any problem or disagreement with our services, please contact our support channels, observing the present Terms of Use and our other rules, so that we try a consensual solution. However, if you understand that it is the case to judicialize the demand, filing an action against Jarbas in court, the competent forum should be the District of Ituverava-SP or that of your domicile.

ANNEX - PROHIBITED PRODUCTS AND SERVICES

When registering an advertisement, the user must verify the list of prohibited products on Jarbas, transcribed below:

1. Any type of illegal service or product;
2. Drugs or any other type of narcotic substance not allowed by current law, as well as equipment and objects intended for consumption or manufacture of any type of drugs;
3. Cigarettes, cigars or tobacco, essences with tobacco and nicotine and electronic cigarettes. Firearms of high or low caliber, including replicas, silencers, pressure weapons, bullets and ammunition, accessories and/or parts for any type of weapon;
4. Courses that teach how to modify firearms and tools or services that allow modifying weapons;
5. Grenades, explosives, missiles, fireworks, gunpowder, destruction devices, products for assembling explosives;
6. Dangerous and/or controlled chemical substances by the Army or Police;
7. Products without homologation, approval and registration by the corresponding government agencies such as, for example, ANVISA, INMETRO, ANATEL, MAPA or ANS;
8. Medicines in general or other products with therapeutic attribution, hearing aids, oxygen tubes, prostheses and implants and medical equipment, except domestic use devices;
9. Human beings, human organs, skeletons and bones, corpses, body fluids, surrogate motherhood;
10. Substances containing anabolics and/or steroids, products with botulinum substance;
11. Products out of commerce, such as stolen property, products delivered by the government within the scope of social programs whose sale is prohibited, products whose sale is exclusive to the State or by authorized entities, expired products, products on loan;
12. Perishable and non-perishable food, beverages and food inputs that are not suitable for the consumption they are intended for or that violate any applicable regulation, including the need for registration or homologation before the competent agencies;
13. Personal databases and email lists, personal or company registrations, software for sending mass messages;
14. Identity documents, CPF, CNH, passport, diplomas etc, business documentation, as well as financial records or other personal information, as well as instruments that allow illegal manufacture of official documents;
15. Student document preparation services, such as theses, monographs and practical work;
16. Products that represent or promote harassment, hatred, violence or intimidation to individuals or groups of any kind and/or nature, based on prejudices of all kinds, such as race, color, ethnicity, national or religious origin, gender, sexual orientation, social and economic condition, intellectual etc. Advertisements for products that are the result of jokes or that lead the buyer to make mistakes, which may or may not be characterized as criminal conduct;
17. Prostitution services and/or similar;
18. Pedophilia, or any material that refers to or involves minors and child pornography;
19. Products that violate legislation that protects artistic assets, of historical, archaeological, prehistoric, numismatic interest, libraries, document collections etc. Replicas or counterfeit or pirated items or any other product that violates laws on copyright, patents, trademarks, models, industrial designs or industrial secrets;
20. Financial products and services, including stocks, bonds, cautions, consortia contemplated or not, financing, bank accounts, credit, debit cards, products for card transactions, used machines, insurance, cryptocurrencies, coins and tickets in circulation. Animals in extinction or at risk of extinction, wild animals or whose hunting/commercialization is prohibited by law or for any other reason, organs, members or animal skin;
21. Bets, bingos and any games of chance;
22. Decoders, receivers, services or antennas used for illicit purposes, such as, for example, paid channel unlockers; Tickets, excursions, air miles, discount coupons and similar items;
23. Personal relationships, meetings, dating.
